1. Acceptance of Terms
By accessing or using The Dog Coach platform ("Service") operated by Discover Group Sàrl ("Company", "we", "us"), you agree to be bound by these Terms of Service and all applicable Australian laws and regulations, including the Australian Consumer Law (ACL) as set out in Schedule 2 of the Competition and Consumer Act 2010 (Cth). If you do not agree, please do not use our Service.
2. Description of Service
The Dog Coach provides an AI-powered dog behavior coaching platform that delivers personalised training plans, daily missions, behavioural analysis, and real-time chat support. The Service is for informational and training guidance purposes only and does not constitute professional veterinary or clinical animal behaviour advice.
3. Australian Consumer Law Guarantees
Our Service comes with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the Service repaired or replaced if the Service fails to be of acceptable quality and the failure does not amount to a major failure.
Nothing in these Terms limits, excludes, or modifies any consumer guarantee, right, or remedy you have under the ACL that cannot lawfully be limited, excluded, or modified.
4. Eligibility
You must be at least 18 years of age to use this Service. By using the Service, you represent that you are 18 years or older. If you are under 18, please do not use our Service.
5. Subscription and Payment
The Service is offered on subscription plans:
- Behavioral Reset: AUD equivalent of €79 / 6 months
- Full Access Annual: AUD equivalent of €149 / year
Prices displayed are inclusive of GST (Goods and Services Tax) where applicable for Australian residents. All payments are processed securely through our payment provider. Subscriptions automatically renew unless cancelled before the renewal date.
6. GST Compliance
The Dog Coach is registered for GST purposes where required under the A New Tax System (Goods and Services Tax) Act 1999 (Cth). For Australian customers, GST is included in the displayed price. Tax invoices are available upon request.
7. Cancellation and Refunds
You may cancel your subscription at any time by contacting us at contact@thedogcoach.co. Upon cancellation:
- You will retain access to the Service until the end of your current billing period
- No further charges will apply after cancellation
- Refunds are available within 14 days of purchase for the current billing period if the Service has not been substantially used
- Your rights under the Australian Consumer Law to a refund for a major failure are not limited by this policy
8. Acceptable Use
You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not: use the Service for any unlawful purpose or in a manner that violates any applicable law; share your account credentials; reverse engineer or copy any part of the Service; or use the Service to harm animals.
9. Intellectual Property
All content, training protocols, AI models, and materials provided through the Service are the intellectual property of The Dog Coach or its licensors. You are granted a limited, non-exclusive, non-transferable licence to access and use the Service for your personal, non-commercial use.
10. Limitation of Liability
To the extent permitted by law (and subject to your rights under the ACL), our liability to you for any loss or damage of any kind arising out of or in connection with these Terms or the Service is limited to the amount you paid for the Service in the 12 months preceding the claim.
We are not liable for any indirect, incidental, special, consequential, or punitive damages, except where such limitation is prohibited by the ACL.
11. Dispute Resolution
We are committed to resolving any disputes quickly and fairly. Please contact us first at contact@thedogcoach.co. If we cannot resolve your complaint, you may contact the relevant consumer protection authority in your state or territory, or the Australian Competition and Consumer Commission (ACCC) at accc.gov.au.
12. Governing Law
These Terms of Service are governed by the laws of the Commonwealth of Australia and the relevant state or territory laws. Any disputes are subject to the exclusive jurisdiction of Australian courts.
13. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes by email or through the Service. Your continued use after changes constitutes acceptance of the updated Terms.
